Divorce Application
A divorce application can be made through the Commonwealth Courts Portal once you have been separated for more than 12 months. You can lodge this yourself, and the Federal Circuit and Family Court of Australia website has a lot of guidance as to how to do just that. We have also prepared a blog doing the same. Unfortunately, however, the filing fee for a divorce is expensive, and if you get it wrong there is a chance your application will be rejected or lapse and you will need to start again and pay a new filing fee. To avoid such an issue, sometimes people prefer to have their divorce prepared by a lawyer, and we can help with that.
- Receive advice about whether you are eligible for divorce, and the evidence required
- Understand what to do if you have been separated under one roof, or the other person does not want a divorce
- Receive the prepared divorce application and supporting documents for your signature, which we can then file on your behalf
